By accessing and using NST Sports' website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

NST Sports provides nervous system training (NST) programs designed to enhance athletic performance. Our services include:

• In-person training sessions at our facilities
• Customized training programs
• Performance assessments
• Team training programs
• Educational resources and consultations

3. User Eligibility and Registration

To use our services, you must:

• Be at least 6 years old (with parental/guardian consent if under 18)
• Provide accurate and complete registration information
• Complete required health and fitness assessments
• Comply with all applicable local, state, and federal laws

4. Health and Safety

Medical Clearance

Prior to participating in any training program, you must obtain clearance from a qualified healthcare provider. You represent and warrant that you are physically fit and have no medical conditions that would prevent safe participation in athletic training.

Assumption of Risk

You acknowledge that participation in athletic training carries inherent risks, including but not limited to muscle strain, injury, or other physical harm. You voluntarily assume all risks associated with participation in our programs.

Release of Liability

By using our services, you release NST Sports, its owners, trainers, employees, and affiliates from any and all liability for injuries or damages arising from your participation in our programs, except in cases of gross negligence or willful misconduct.

5. Payment Terms

• All fees must be paid in advance unless otherwise agreed
• Prices are subject to change with 30 days notice
• Refunds are handled on a case-by-case basis in accordance with our refund policy
• Late payments may result in suspension of services
• You are responsible for all applicable taxes

6. Cancellations and Rescheduling

Session cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may result in forfeiture of the session. We reserve the right to cancel or reschedule sessions due to trainer availability, facility issues, or weather conditions.

7. Code of Conduct

All participants must:

• Treat trainers, staff, and other participants with respect
• Follow all facility rules and trainer instructions
• Use equipment properly and safely
• Maintain appropriate attire and hygiene
• Refrain from disruptive or inappropriate behavior

Violation of our code of conduct may result in immediate termination of services without refund.

8. Intellectual Property

All content on our website and in our training materials, including text, graphics, logos, training methodologies, and software, is the property of NST Sports and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

Our services are provided "as is" without warranties of any kind. We do not guarantee specific performance outcomes or results. Individual results may vary based on numerous factors including but not limited to effort, consistency, genetics, and prior athletic condition.

11. Limitation of Liability

To the maximum extent permitted by law, NST Sports shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NST Sports from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Stark County, Ohio.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
